Terms
of a Licence for software of the German Aerospace Centre
(Deutsches
Zentrum für Luft- und Raumfahrt e.V.)
1. Acceptance: By
sending the request to automatically receive a Matlab
implementation and description of the channel model the customer
accepts the subsequent terms of a licence.
2. Proprietary
Program/Copyright/Patent Rights: The program „land mobile
multipath channel model“ (hereinafter called
„program“) is proprietary of the German Aerospace Centre (Deutsches
Zentrum für Luft- und Raumfahrt e.V.) and is protected by the
German Copyright Act. Furthermore the program is protected by several
patents. A transgression of the rights of use expressly granted
hereinafter constitutes a penal relevant violation of the German
Copyright Act as well as the German Patent Act and will in each case be
prosecuted.
3. Granting of
a non-commercial licence: The program is made available to the
customer with a description free
of charge and only for non-commercial research and scientific purposes.
With acceptance of these terms of a licence the customer receives -
without the right to grant sublicenses - a non exclusive, non
transferable right to use the program for non-commercial research and
scientific purposes. Any use of the program for commercial purposes is
strictly forbidden, in particular the implementation of the program in
a hardware channel simulator, in a commercial simulation software or in
a commercial hardware or software receiver.
4. Transfer to
third persons: It is strictly forbidden to make the program or
the description
available to third parties, whether free of charge or against payment.
The customer has to take all necessary and reasonable precautions to
prevent that third parties gain access to the program or the
description.
5. Decompile
and program modification: The retranslation of the delivered
program code in other forms of code
(decompile) as well as any other form of Reverse-Engineering or
modification of the program by the customer is prohibited. Accordingly
any modification of the source code made available to the customer is
strictly forbidden.
6. Exclusion
of warranty: In terms of the fact that the program is made
available to the customer
free of charge and only for non-commercial purposes, guarantee claims
no matter of what kind are excluded. In particular it is not warranted
that the program is useful for the application areas desired by the
customer. Furthermore there is no warranty assumed for the correctness,
usability and completeness of the description. Finally it is not
guaranteed that the program does not infringe upon third party property
rights.
7. Limitation
of liability: For damages to other software, data media and/or
computer installations
etc. of the customer arising by the use of the program as well as
consequential damages or losses through this, the German Aerospace
Centre (Deutsches Zentrum für Luft- und Raumfahrt) is liable only
in cases of intended or gross negligent causation of the defect causal
for the damage by its employees or statutory agents. In case the
customer is businessman according to § 14 of the German Civil
Code, beyond the limitation of liability according to the preceding
sentence the liability is limited to predictable, typically appearing
damages and furthermore the liability for gross negligence of the
employees of the German Aerospace Centre (Deutsches Zentrum für
Luft- und Raumfahrt) is excluded, with the exception of gross
negligence of an executive employee.
8. Appliable
Law/Place of Jurisdiction: German law applies to the contractual
relationship between the German
Aerospace Centre (Deutsches Zentrum für Luft- und Raumfahrt) and
the customer concerning the demonstration licence according to these
terms of a licence. Place of jurisdiction for all disagreements arising
out of this contractual relationship is Cologne, Germany.
